Terms and conditions

This document states the terms and conditions that apply to Customers using this Website to make one off or occasional purchases of products from Plant Based Planet. Plant Based Planet may also include on this website (the Website) information relating to products or services which may be of interest to Customers, provided or offered by Plant Based Planet’s partners.

Payment is required in advance for any single order placed.

Customers should consult the Website for details of quantities, weights and ingredients, including allergy information, for their preferred product option.  Contents of packages are varied monthly at the discretion of Plant Based Planet.

Prices stated on the Website are correct at the time they are added by Plant Based Planet.  Prices may be changed at any time, without notice.  Subscription service pricing shall be as stated on the Website.  Where Plant Based Planet changes pricing of packaged products stated on the Website, the price payable by the Customer shall change from the date the amended price appears on the Website.  For single orders, the price payable shall be as stated on the Website at the date of order.

Plant Based Planet may be subject to changes in costs of delivery, which result from the selected carrier amending its pricing policy or price structure.  These changes will be applied to orders sent out for delivery from the date the carrier’s changes take effect. Plant Base Planet will use its reasonable endeavours to notify Customers of changes in the costs of carriage and delivery by amending the pricing information on the Website, but is not liable for any increased costs incurred due to price changes by carriers or other third parties.

Subscriptions are based on payment before delivery, with credit card, debit card or bank details provided and a monthly deduction made for the price of the selected offering.  Cancellation of payments during the initial 12 month period will incur a debt payable on demand for the remainder of the subscription period.  Plant Based Planet reserves the right to charge interest on late payment or non-payment of 2% above Barclays Bank base rate.

Customer payment details, including delivery address and invoice address if different, will be retained by Plant Based Planet for all Customers in accordance with the Customer information management and retention guidelines in these Terms of Use.

General Conditions of Use

The Website is owned by Plant Based Planet Limited (Plant Based Planet), a company registered in England and Wales.  The Website is operated by a third party on behalf of Plant Based Planet.  The Website consists of multiple website pages and interactive components that enable Customers to interact with Plant Based Planet.

The Website facilitates Customers joining Plant Based Planet’s subscription service which delivers to Customers each month selections of vegan snacks and sweets selected by Plant Based Planet, which are varied in content and quantity at our discretion.  The monthly subscription service is the primary offering to Customers by Plant Based Planet.

The Website also facilitates Customers who want to make individual or occasional purchases of vegan snacks and sweets advertised on the Website.

These terms and conditions should be read before commencing use of the Website.  By accessing the Website, either as a subscriber or a guest, the user is accepting in full, these terms and conditions.  Interaction with the Website also means that the user is accepting these terms and conditions.  Where a conflict arises between these terms and conditions and specific content on the Website uploaded by Plant Based Planet the latter shall take precedence.

The Website complies with current legislation concerning information use and management.  Nothing in these terms and conditions shall exclude or limit the responsibility of Plant Based Planet to comply with government, court, legal or law enforcement requests or requirements for information or data on any user.

If any part of these terms and conditions is deemed invalid or unenforceable under applicable law, including but not limited to any warranty, disclaimer or limitations of liability stated herein the term so affected shall not affect or limit the remainder of these terms and conditions. which shall continue in full force and effect.

These terms and conditions, except as allowed for in paragraph 6 above of this section “General Conditions of Use”, forms the entire agreement between Plant Based Planet and the user in respect of the website.

Users cannot assign or otherwise transfer the obligations set out in these terms and conditions.  Plant Based Planet may assign its rights under these terms and conditions at will.  Notices to users, including changes to the terms and conditions, shall be deemed served on all users by placement on the website.  Printed copies of these terms and conditions shall be admissible in any proceeding, whether judicial or administrative, in respect of the website.  The jurisdiction of the English Courts and the Law of England and Wales shall apply to these terms and conditions and to the use or accessing of the website.

Intellectual Property

Copyright, database rights, content and other intellectual property rights associated with the Website belong to Plant Based Planet or its licensors.  Access and/or use of the Website does not grant or transfer any rights to Customers, except where such rights are pre-existing.

A single print or download to a local hard disk or other electronic storage medium of content is permitted, no other copying, distributing, selling, or publication of any content or of any third party products or services considered by Customers  is permitted.

Liability

Except for death or personal injury resulting from the negligent acts or omissions of Plant Based Planet, Plant Based Planet will not be liable in any manner or form for any damages arising in contract, tort including negligence, or otherwise in respect of loss or damage arising from the use of the Website.  No liability for any direct, indirect or consequential loss or damage in contract, or tort including negligence, loss of profit, loss or damage to property or relating to third party claims.

Where the Website or any content contains or provides links to third party providers of goods and/or services, the links are only provided to facilitate Customers informing themselves further about the third party.  Plant Based Planet does not sponsor, affiliate itself or is associated with, except where explicitly stated, or where legally authorised to use, any trade mark, registered trademark, logo, legal seal or copyrighted symbol, in any link.  Plant Based Planet does not have any responsibility or control over the material third party providers use or present on their websites or information portals.  No loss, injury, claim, liability or damage related to use of any website accessed via a link, including errors or omissions in content, availability of that website, or arising from any other use of the website shall apply to Plant Based Planet as a result of using the websites accessed via links.

Plant Based Planet uses reasonable endeavours to ensure information on the Website is correct and complete.  However, Plant Based Planet does not guarantee the accuracy or authenticity of information, therefore users accessing the Website should check any information accessed before making a decision on any action users take.  Links to third party websites are correct at the date they are added to the Website, but Plant Based Planet does not guarantee that the links remain active or provide access to third party websites or information portals.  No guarantee is provided by Plant Based Planet that any product or service continues to be available when a Customer seeks further information on a specific product or service.

Plant Based Planet provides the listed goods and services only.  Customers may be required to register with third parties and to provide additional personal information in order to access information or make purchases.

Plant Based Planet will use reasonable endeavours to ensure the Website is available 24 hours per day.  Plant Based Planet accepts no liability for costs, expenses, losses or liabilities that any user of the Website may incur as a result of the Website being unavailable for whatever reason.

Service Delivery

Plant Based Planet is a single user digital service for business to general public purposes.  Use of the Plant Based Planet service is for registered users only, at the registered email address, with each registered user allowed only one registration.  Shared use of registered email address, or use of the Website by an unregistered user using a registered email will be deemed a breach of this agreement.  Any registered user wanting to change or amend the email address used to access the service must notify Plant Based Planet in writing of the change.  Plant Based Planet will not be liable in any way for any non-delivery of the Plant Based Planet service provided by the Website.

Unlawful or Prohibited Use

Users warrant that they will not use the Website for any purpose that is unlawful or prohibited by these terms and conditions and any notices on the Website.  No use of the Website may be made which may damage, disable, overburden or impair the Website, or interfere with the use and enjoyment of the Website by any third party.  Users must not use the Website for any purpose that may be deemed immoral, discriminatory or constitute an unlawful or criminal act.  Users must not obtain or attempt to obtain materials or information not intentionally provided as information supplied by the Website.

Variations

Plant Based Planet may alter, amend or otherwise change the Website and the terms of use of the Website at any time.  Users of the Website continuing to use the Website after any change has been made will be bound by the revised terms and conditions of use.

Law and Jurisdiction

These terms and conditions are governed and construed in accordance with laws of England and Wales, disputes arising in connection with these terms and conditions shall be exclusively subject to the jurisdiction of the courts of England and Wales.  The laws of England and Wales shall govern and interpret these terms and conditions in the matter of any dispute or claim arising out of or in connection with these terms and conditions, their subject matter or formation, including non-contractual disputes or claims.
